Terms of Service

Cast & Color (the “Service,” “we,” “us,” or “our”) provides an online tool for generating personalized coloring pages. By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. Eligibility

You must be at least 18 years old to create an account. The Service is intended for adults, primarily parents and guardians who want to make coloring pages featuring the people they love. The Service is not directed at children under 13.

2. Your account

You’re responsible for activity under your account, including keeping your sign-in credentials secure. You can close your account at any time from the account page.

3. What you upload

When you upload a photo of another person, you represent that:

• You have permission from that person to upload their photo and use it to generate coloring pages.
• If the person is a child, you are their parent or legal guardian and you consent on their behalf to the processing described in our Privacy Policy.
• The photo does not contain nudity, sexual content, hate symbols, harassment, or anything illegal.

We may remove content that violates these rules and may suspend or close accounts that repeatedly violate them.

4. Privacy

Your data is handled as described in our Privacy Policy, which is incorporated into these Terms by reference.

5. How generated pages work

You enter a scene description and select cast members, and we send those inputs (including their photos) to a third-party AI image generation provider that produces the coloring page. The output is provided to you for personal, non-commercial use. You may print and color the pages, share them with people you know, or post them on personal social media. You may not resell the generated pages or use them for commercial purposes without our written permission.

We do not guarantee that any specific generated page will meet your expectations. AI generation is probabilistic and outputs vary.

6. Credits and payments

The Service is offered through monthly subscriptions. Each generation consumes one credit. Subscription tiers, prices, and monthly credit allowances are shown on the pricing page and at checkout. New accounts receive a small number of free credits each month, which refresh on the first of the month and do not roll over.

Renewals and cancellation. Subscriptions renew automatically each month at the then-current price until you cancel. You can cancel anytime from your account page; cancellation stops future renewals and your subscription remains active through the end of the current billing period. Unused subscription credits roll over while your subscription is active.

Refunds. All sales are final once a generation has been performed in the current billing period. We do not pro-rate refunds for partial months. If you believe you were charged in error, email castncolor@gmail.com and we’ll review case-by-case.

Credits have no cash value and cannot be transferred to other accounts. Subscription credits expire when the subscription is canceled and any remaining credits have been used. Free credits reset each month.

7. Acceptable use

Don’t use the Service to:

• Generate content that depicts real people (including children) in sexual, harmful, harassing, or defamatory contexts.
• Generate content that infringes intellectual property rights, including trademarks and copyrighted characters.
• Probe, scrape, or attempt to reverse-engineer the Service.
• Resell or redistribute outputs in commercial products.

8. Your content, your rights

You keep all rights to the photos you upload. By uploading, you give us a limited license to store, process, and transmit those photos to the service providers we use (including the AI image generation provider) solely to operate the Service for you.

You also own the coloring pages generated from your inputs, subject to the personal-use restrictions in section 5.

9. Copyright complaints

If you believe content on the Service infringes your copyright, email castncolor@gmail.com with: a description of the work you claim is infringed, the URL or location of the allegedly infringing material on the Service, your contact information, and a statement that you have a good faith belief the use is not authorized. We will review and respond within a reasonable time.

10. Service changes and availability

We may add, change, or remove features at any time. We may also suspend the Service for maintenance or for reasons outside our control. We aim for high availability but make no uptime guarantees.

11. Termination

You can close your account at any time. We can suspend or close accounts that violate these Terms or that we reasonably believe pose legal or safety risks. On account closure, your uploaded photos and generated pages are deleted, and any unused credits are forfeited unless eligible for refund under section 6.

12. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that outputs will be accurate, appropriate for any specific purpose, or free of errors.

13. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred U.S. dollars ($100). We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or emotional distress, even if we have been advised of the possibility.

14. Indemnification

You agree to defend and hold us harmless from any claim brought by a third party arising out of your violation of these Terms, your misuse of the Service, or content you upload.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. If a change is material, we’ll let you know by email or in-app notice. Continued use of the Service after the effective date means you accept the new Terms.

17. Assignment

You may not assign these Terms without our written consent. We may assign these Terms to a successor entity (for example, if the Service is reorganized or sold).

18. General

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.

Severability. If any provision of these Terms is held invalid or unenforceable, the rest stays in effect.

No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
